It may still load up eventually if you can see letters appearing in the top-left corner of the screen. Just takes a couple minutes for whatever reason.
Alternatively, you can run it windowed, in which case it should look fine but ... well, it's windowed. Also, enabling the "disable desktop composition" compatibility setting helps in full-screen mode I think, but the colours are still all strange (for some people at least).
If I recall correctly someone said that it works perfectly in Glide mode, but most people will need a wrapper unless they have a Voodoo card lying around somewhere (which may or may not even have working drivers, come to think of it).

Many of the old timers have/do use this. I haven't seen anyone banned for it. The official blizz statement was something like, it's not something they actively look for, but we won't promise that you won't be banned at some point. That statement was given a long time ago.

I think Blizzard should seriously consider b&s for Glide emulator users. Not only are they 3rd party programs but the emulation of features from the old 3dfx Voodoo cards D2 was designed for gives users of glide wrappers an unfair advantage over legit players. If you weren't such a stupid random you would know this.

You need to set compatibility for game.exe and Diablo II.exe to Windows XP SP 2 or 3. It works perfect for me on Windows 7 64-bit with XP SP 3 compatibility mode and admin rights. I had your problem before I did this.
