Back when I was reporting spambots and item sites manually, I was told that a majority of the item sites were "registered outside of the US" and as such "feel they can ignore US law" or at least have extreme difficulty accepting the law.

Thing is, they really need to look at the fine print in the TOU stating the game and its laws are governed under the state of California, meaning all of the laws of California and the US should be applied anywhere as long as it covers part of the game.

In order for these site owners to sell items, they have to have the items in their "possession" and copies of Diablo II to "deliver" these items.

Eh, hopefully they'll die out when Diablo III goes up.
